Pakistan amends PPC and CrPC to protect Army and Judiciary from criticism; offenders will receive five-year prison sentence

A Draft Bill vetted by Pakistan Ministry of Law and Justice and initiated by Ministry of Interior for the Prime Minister and federal cabinet proposes to change Pakistan’s Penal Code (PPC) and Code of Criminal Procedure (CrPC) , states that anyone who scandalizes or ridicules Pakistani Army and Judiciary through any medium will be awarded up to five year imprisonment.

As criticism of the Army and the courts has been pouring onto social media, the Cabinet summary has stated the objectives of the soon to be introduced measure.

The Criminal Laws (Amendment) Act 2023, which was submitted by Pakistan's Ministry of Interior, recommends adding section 500A, which is captioned ‘Intentional ridiculing or scandalizing of the state institutions etc.

Offence is punishable with simple imprisonment for 5 years or with a fine i.e. Pakistani Rupees (PKR) I million

Further, it adds that some offences are punishable by simple imprisonment for a term up to five years, a fine up to one million Pakistani rupees (PKR), or a combination of the two. In the interim, a new part to Section 500 called 500 A has been created, which specifies that the perpetrator will be detained without a warrant and the crime will not be subject to bail or computation. The arrest may be contested by the perpetrator before a session's court, nevertheless.

A number of scandalous, derrogatory, and no holds barred vicious attacks, including the judiciary and armed forces, were also mentioned in the cabinet summary. Additionally, it claimed that some wings with ulterior purposes had started a cyber-campaign to foment campaigns against specific governmental institutions and their personnel.

It also states that the purpose of such heinous crimes is to undermine the independence, stability, and integrity of Pakistan's governmental institutions.
