 Haryana News : Punjab and Haryana High Court Stresses State's Responsibility towards Temporary Employees

Haryana News: The Punjab and Haryana High Court has issued a significant directive emphasizing the responsibility of state governments towards temporary employees. In a recent ruling, the court clarified that once the state government permits temporary employees to continue their service in the positions they were initially appointed to, it cannot claim that there is no regular work available for those positions.

Punjab and Haryana High Court Stresses State's Responsibility towards Temporary Employees

Justice Harsimran Singh Sethi, in the court's orders on several petitions, highlighted that if an employee has served for more than a decade and the work for their post still exists, it is the state's obligation to create a permanent position to facilitate the employee's continued service. The judge stressed that as a welfare state, the government should prioritize the welfare of its employees rather than raising objections to deny their claims, especially when their regularization falls under the state's applicable policies.

Court Directs Haryana Government to Regularize Services of Temporary Employees

The court has directed the Haryana government to issue a speaking order in compliance with the court's decision regarding the regularization of services for petitioners who have been serving in various departments on a temporary basis but are entitled to regularization as per state policies. Additionally, the bench instructed the state to create regular posts of diminishing nature to accommodate such employees whose services have been regularized.
